Chapter 7: The Agreement My Wife Buried

At 4:36 a.m., my phone rang for the sixth time.

I had not slept.

Every time I closed my eyes, I saw Vanessa standing in the hallway with that manila folder pressed against her chest. I heard her voice breaking as she mentioned an agreement I supposedly had signed before our marriage. And I kept returning to the same question.

What could Daniel Cross possibly have that would allow him to control something I didn't even know existed?

I answered the call.

"Vanessa, start talking.""

For several seconds, all I heard was breathing.

Then she whispered, "I need you to promise me something.""

"No.""

"Andre, please.""

"I'm done making promises before I know what I'm agreeing to.""

She exhaled shakily.

"Daniel has the original prenuptial agreement.""

I sat upright on the edge of the bed.

"What does that have to do with him?""

"There's an amendment attached to it.""

"What amendment?""

"I don't know how to explain it.""

"Try.""

She was quiet for so long that I checked whether the call had disconnected.

Finally, she said, "When we got married, you signed several documents your attorney prepared. One of them concerned the money Elena left Maya.""

I remembered the paperwork.

Before our wedding, my attorney had recommended that I keep Elena's estate separate from our marital finances. I had agreed. Maya's inheritance belonged to her, and I wanted to protect it.

I had signed the documents in my attorney's office.

But I had never signed anything giving Daniel Cross control over the trust.

"I remember the agreement," I said.

"It protected Maya's inheritance.""

"Yes.""

"Then what did you change?""

"I didn't change anything.""

"Vanessa.""

Her voice rose.

"I didn't forge your signature! Daniel said there was an amendment that allowed him to act as a financial representative if certain conditions were met. He said it had already been approved.""

"By whom?""

"Your attorney, I think.""

"You think?""

"I didn't read every page!""

I stood and began pacing.

"You've been handling financial documents involving my daughter, my home, and a man whose debt you've been secretly paying. And you didn't read the documents?""

"I was desperate!""

"For what?""

She began crying again.

I waited until she could speak.

"Daniel told me the debt was going to become public. He said creditors could pursue me because I had guaranteed the original loan. He said if I didn't arrange the money quickly, Devin and I could lose everything.""

"Your personal debt does not give you the right to use Maya's inheritance.""

"I know that now.""

"No. You knew it before. That's why you hid it.""

She fell silent.

I looked at the clock.

In three hours, Maya and Devin were supposed to be in the car with me, heading to the airport.

"Where is Daniel now?"" I asked.

"I don't know.""

"Where is the original agreement?""

"At his office.""

"Then I'll get it through the proper legal process.""

"Andre, you don't understand. Daniel said if you challenged the agreement, he would expose everything.""

"What is everything?""

She whispered something I couldn't hear.

"Speak up.""

"He said he would tell everyone about the money.""

I stopped pacing.

"What money?""

"The money from Elena's estate.""

I felt a cold sensation spread through my chest.

"Are you saying he has records showing that you moved money from Maya's trust?""

"Yes.""

"Of course he does. He was involved in the transfers.""

"No, Andre. You don't understand. He has records from before we married, too.""

I closed my eyes.

"Vanessa, what did you do?""

She didn't answer.

Instead, she said, "You need to look in the blue safe in your office. There's a folder behind the insurance documents.""

I turned toward the office.

"Why is there a folder in my safe that I don't know about?""

"Because I put it there.""

"Without telling me?""

"I was going to explain everything.""

"When?""

She sobbed.

"I don't know!""

I ended the call.

Then I went downstairs, unlocked the safe, and moved the insurance papers aside.

Behind them was a thin blue folder.

Inside were copies of bank statements, several letters, and a document bearing the seal of the law firm that had handled my marriage agreement.

The first letter was dated seven years earlier.

It concerned the administration of Elena's estate.

I read it twice.

The letter confirmed that Maya's inheritance had been placed in a protected trust. It also stated that no spouse, guardian, or third-party representative could redirect the funds without the authorization required by the trust documents.

That was exactly what I remembered.

But the second document was different.

It was an amendment dated fourteen months earlier, bearing a digital signature attributed to me.

The amendment appeared to grant Daniel Cross limited authority over certain administrative functions connected to a separate investment account.

It did not explicitly give him ownership of the trust.

However, a handwritten note in the margin referenced a related agreement.

See Schedule C for collateral provisions.

There was no Schedule C in the folder.

I photographed every page and sent the images to Michael.

He called within minutes.

"Where did you get these?""

"They were in my safe. Vanessa told me to look for them.""

"Do you remember signing the amendment?""

"No.""

"Don't assume the signature is forged until we examine the original records. But the document raises questions. I'm going to contact the firm that prepared your original agreement.""

"Can Daniel use it to take the house?""

"I can't determine that from this copy. The language appears to concern a separate account, but we need the missing schedule and the complete agreement.""

"What about Maya's trust?""

"The amendment doesn't appear to give him unrestricted access to it. That's important. We need to confirm whether the trust itself was ever amended or whether someone simply used this document to justify transactions that weren't authorized.""

I looked at the stack of papers.

"How quickly can you get answers?""

"I'll make calls this morning. In the meantime, keep the originals secure.""

I hung up and sat at my desk.

For the first time since this began, I felt something more dangerous than anger.

Doubt.

Had I signed something without reading it?

Had I trusted Vanessa so completely that I had allowed a stranger to gain authority over part of my financial life?

Had I been so determined to build a new family that I had failed to protect the one I already had?

A soft knock sounded at the office door.

Maya stood there in her travel clothes.

"Are we still going?""

I looked at her.

She had dark circles beneath her eyes, and her hair was tied into a loose ponytail. She was holding her passport and boarding information.

"Yes," I said.

"We're still going.""

She glanced at the papers.

"Is Vanessa coming?""

"No.""

Maya lowered her eyes.

"Okay.""

I stood and embraced her.

"You don't need to worry about the adults' problems today. Your only job is to get on that plane and enjoy your vacation.""

She nodded against my shoulder.

Then she asked, "Dad, if you signed something by mistake, does that mean this is your fault?""

I pulled back.

"No. If I signed something I didn't understand, I'll take responsibility for that mistake. But nobody gets permission to misuse your money because I trusted the wrong person.""

Maya looked at me for a long moment.

Then she nodded.

At 6:15 a.m., we loaded the suitcases.

Devin carried the largest bag. Maya placed her backpack in the front passenger footwell, then paused beside the car.

She looked at the house.

"Do you think we'll live here when we come back?""

I couldn't promise her what I didn't know.

"I think we will. And I'll make sure we're protected either way.""

She climbed into the car.

I was about to start the engine when a black sedan turned into the driveway.

Daniel Cross stepped out.

He wore a charcoal suit and carried a leather document case.

Devin immediately opened his door.

"That's my dad.""

Daniel looked at him, then at me.

"Andre. I was hoping we could speak before you leave.""

I got out of the car and closed the door behind me.

"You have five minutes.""

Daniel glanced at the house.

"Vanessa told you about the agreement?""

"She told me enough to know you're withholding documents connected to my daughter's trust.""

He shook his head.

"That's not what I'm doing.""

"Then give me the original agreement.""

"I can't.""

"Why not?""

"Because I don't have it with me, and because the matter is more complicated than you think.""

I took a step toward him.

"Every time someone says that to me, it turns out they're hiding something.""

Daniel's expression tightened.

"Fair enough. But I'm not asking you to trust me. I'm asking you to look at the facts.""

He opened his document case and removed a sealed envelope.

"This is a copy of a letter your late wife's attorney sent to the financial administrator of Maya's trust. It explains why certain funds were moved into a separate account.""

I didn't take it.

"Why do you have it?""

"Because Vanessa gave it to me.""

"Why?""

"She wanted me to find a way to settle her debt without involving you.""

"Using my daughter's inheritance.""

Daniel looked down.

"Yes.""

The admission was so direct that it caught me off guard.

"Did you tell her to do that?""

"No. But I knew where the money was coming from, and I didn't stop her.""

He handed me the envelope.

I opened it.

The letter was authentic, at least in appearance. It bore the name of Elena's former attorney and referred to an investment account established alongside Maya's trust.

The account was intended to generate returns for Maya's future education.

It was separate from the protected trust itself, but its funds were still subject to restrictions.

The letter did not authorize Vanessa to use the money for personal debts.

I looked up.

"This doesn't give you any authority over the account.""

"Not by itself.""

"Then what does?""

Daniel hesitated.

"The original agreement contains an additional schedule. It was signed when you and Vanessa married.""

"You're talking about the amendment.""

"Part of it.""

"Where is the schedule?""

"At my office.""

"Then send it to my attorney.""

"I will.""

"Today.""

He nodded.

I started to turn away.

"Andre," he said.

I stopped.

"Vanessa didn't start this debt after she married you. She was already in trouble. She told me she had everything under control, and I believed her because I wanted to believe her.""

"You were her former partner. You knew she was marrying someone who could protect her financially.""

Daniel's face hardened.

"That isn't fair.""

"Isn't it?""

He looked toward the car, where Devin was watching through the window.

"I know how it looks. But I never wanted to take your house.""

"Then why submit an application against it?""

"Vanessa insisted it was the only way to pay the debt before the deadline.""

"And the document bearing my signature?""

"I was told it was valid.""

"By whom?""

He hesitated.

Then he looked directly at me.

"By the attorney who prepared the amendment.""

I stared at him.

"Which attorney?""

Daniel gave me a name.

It was not Michael.

It was not the lawyer who had handled my original prenuptial agreement.

It was a man I had never met.

Before I could ask another question, Daniel's phone rang.

He glanced at the screen.

His face changed.

"What is it?"" I demanded.

He declined the call.

"Someone from Northstar.""

"Why would they be calling you?""

"Because the repayment deadline is today.""

I looked at the document case in his hand.

"How much is still owed?""

Daniel told me.

The amount was larger than the figure Vanessa had admitted the night before.

I felt my stomach tighten.

"Where did the rest of the money go?""

He stared at me.

"I don't know.""

For the first time, I believed he might be telling the truth.

A horn sounded behind us.

Devin had opened the back window.

"Dad, are you coming?""

Daniel looked at his son.

His expression softened.

"No, buddy. Not this time.""

Devin's face fell.

Daniel took a step toward the car, then stopped.

"I'll call you later. I promise.""

Devin didn't answer.

Daniel turned back to me.

"Please look at the schedule before you decide what to do. It could explain everything.""

Then he walked to his sedan and drove away.

I returned to the driver's seat.

Maya looked at the envelope in my hand.

"What was that about?""

"Documents that should have been shown to me a long time ago.""

I started the engine.

As we pulled out of the driveway, my phone vibrated.

An email from Michael.

The subject line read:

*URGENT: ORIGINAL MARRIAGE AGREEMENT — POSSIBLE UNDISCLOSED BENEFICIARY*

I opened it at the next red light.

Michael had located a record from the law firm that prepared my original agreement. A supplemental schedule had been filed alongside the marriage documents, but it was not included in the copy I had received.

The schedule named a third party who could receive payments under certain circumstances.

The name was Daniel Cross.

And the amount authorized under the agreement was almost exactly the balance of Vanessa's debt.

I stared at the screen.

If the schedule was valid, Daniel might have had a contractual claim against an account I believed was protected.

But the email ended with one final warning.

The firm has no record of your personally acknowledging Schedule C. We need to determine who submitted it and whether it was ever legally incorporated into the agreement.

I locked my phone and looked at the road.

Maya was watching the ocean on a travel video, smiling faintly.

Devin sat in the back, staring at his own phone.

For the first time that morning, neither of them was crying.

I wasn't going to let the next discovery steal that small moment of peace.

But as we approached the airport, another email arrived.

This one came from an address I didn't recognize.

There was no greeting.

No explanation.

Just a scanned page with a single sentence highlighted in yellow.

In the event of default, the beneficiary shall be entitled to enforce the collateral provisions against the residence identified in Section Four.

Beneath it was a signature.

Mine.

May you like

And beside it, written in the margin, were four words that made my blood run cold.

*The residence includes all occupants.*
