Chapter 9: The Last Chance to Save My Mother

By midnight, Daniel had made three phone calls.
The first was to Michelle Foster.
The second was to James Whitmore.
The third was to Evelyn's doctor.
He wanted an independent medical assessment, a complete review of her medication, and written confirmation of her ability to make her own decisions.
Michelle arrived at the house shortly after eight the following morning.
She examined the original deed, the notebook, and the flash drive.
"Daniel, we have enough here to challenge the suspicious transfer documents," she said.
"But the emergency application is serious.""
"What exactly can Robert do?""
"He can ask the court to appoint someone to manage your mother's financial affairs if he convinces them she's incapable of doing so herself.""
"She's perfectly capable.""
"Then we need independent medical evidence.""
Daniel nodded.
"Her doctor is coming this afternoon.""
Michelle closed the folder.
"Good. But I also want to know why Robert is so determined to gain control of this property.""
James Whitmore arrived twenty minutes later.
He was a thin man in his late sixties, with silver hair and a leather briefcase.
Daniel recognized him from old family photographs.
James shook his hand.
"Your father would be glad you found the notebook.""
Daniel gestured toward the living room.
"Please sit.""
James placed several folders on the table.
"I brought the original accounting records.""
He opened the first folder.
Inside were bank statements, invoices, and company records.
"Your father began investigating missing money almost a year before he died," James explained.
"How much?""
"Initially, about eighty thousand dollars. But the amount increased when he discovered transfers through several companies.""
Michelle leaned forward.
"Were these companies connected to Robert Cole?""
"Yes. One was registered under his brother's name. Another was connected to Patricia Mitchell.""
Daniel looked at the statements.
"Why would my father let this continue?""
"He didn't. He was collecting evidence.""
James removed another document.
"Your father discovered that Robert had been using his authority to approve property expenses that never happened.""
"Fake repairs?""
"Exactly. Roof replacements, electrical work, structural maintenance. Hundreds of thousands in invoices.""
Daniel stared at the papers.
"The building hasn't had any major repairs in years.""
"That's because the money wasn't going into the building.""
Michelle examined one invoice.
"Who approved these payments?""
James pointed to the bottom.
"Robert Cole.""
Daniel looked at the next page.
Then he saw Patricia's name again.
"She received money from these companies?""
James nodded.
"Some payments were disguised as consulting fees. Others were transferred through an account registered to a company she controlled.""
Daniel rubbed his face.
"So my father knew Patricia was involved before I married Vanessa.""
"Yes.""
"Why didn't he tell me?""
James hesitated.
"Because your father discovered something else.""
"What?""
James opened his briefcase and removed a sealed envelope.
"This was written three days before he died.""
Daniel recognized his father's handwriting.
He opened it.
Daniel,
I need you to understand something. The people who have access to your home are not always the people who care about your family.
I discovered that Robert has been using Patricia to get close to our financial records. I believe she has also involved Vanessa.
I don't know how much Vanessa knows. I hope she knows nothing.
But if she ever asks you to sign documents relating to Westbrook Avenue, do not do it without independent advice.
Daniel stopped reading.
He looked at James.
"Why did you keep this from me?""
"Your father asked me to wait until the evidence was complete.""
"And when did you consider it complete?""
James lowered his eyes.
"After your father's death, Robert told me he had taken care of everything. I believed him.""
Michelle closed the envelope.
"Did you know about the forged documents?""
"No.""
"Did you help prepare the transfer application?""
James shook his head.
"Absolutely not.""
Daniel looked at him.
"Then why did Robert tell the facility he was representing the family?""
James's expression changed.
"Because he was trying to use the old power of attorney.""
Michelle leaned forward.
"What old power of attorney?""
James looked at Daniel.
"Your father had given Robert limited authority to manage certain business transactions years ago. It was supposed to end when your father died.""
Daniel felt his stomach tighten.
"Did it?""
"It should have.""
Michelle looked sharply at him.
"Should have?""
James nodded.
"I discovered last month that Robert had submitted a document claiming the authority was still valid.""
Daniel stared at the table.
Everything was connected.
The missing money.
The care facility.
The forged signatures.
The original deed.
Robert had been trying to regain control of the property while using Evelyn's age and Vanessa's cooperation to make the transfer appear legitimate.
Then Michelle's phone rang.
She listened for a moment.
Her expression changed.
"Thank you. Please send that to me immediately.""
She ended the call.
"What happened?"" Daniel asked.
"The court has received Robert's application.""
Daniel stood.
"Already?""
"Yes. And he has attached a medical report claiming your mother has significant cognitive impairment.""
Daniel's jaw tightened.
"That report is false.""
"Then we need to challenge it.""
Michelle looked at James.
"Can you identify the clinic?""
James read the document.
"Northwood Family Practice.""
Daniel immediately recognized the name.
"That's where Vanessa took Mom.""
Michelle studied the report.
"There's something unusual here.""
"What?""
"The doctor's signature.""
James leaned closer.
Then he shook his head.
"That doctor retired two years ago.""
Daniel stared at the page.
"You're sure?""
"I've known him for twenty years.""
Michelle took a photograph of the document.
"This could be important.""
Just then, Evelyn entered the room.
She was dressed in a cream sweater and dark trousers. Her silver hair was neatly combed.
Daniel stood.
"Mom, you should be resting.""
"I've rested enough.""
She looked at Michelle.
"Are you the lawyer?""
Michelle stood and introduced herself.
"Yes, Mrs. Carter.""
Evelyn sat down.
"I want to make something clear. I know who I am. I know where I live.
I know what I own. And I know I never agreed to move into a care facility.""
Michelle smiled gently.
"I believe you. But I'd like an independent doctor to document your wishes and assess your ability to manage your affairs.""
"Of course.""
Evelyn looked at Daniel.
"Your father worked too hard for that property to be stolen.""
Daniel took her hand.
"We won't let that happen.""
At two in the afternoon, Dr. Helen Morris arrived.
She had been Evelyn's physician for five years.
She conducted a private assessment, asking Evelyn questions about her daily routine, medication, finances, and personal decisions.
Evelyn answered every question clearly.
She even corrected the doctor when she accidentally referred to an old medication that Evelyn had stopped taking months earlier.
At the end of the assessment, Dr. Morris closed her notebook.
"Mrs. Carter, I have no reason to believe you lack the capacity to make your own financial or personal decisions.""
Daniel exhaled.
Michelle nodded.
"Thank you, Doctor.""
Dr. Morris turned toward Daniel.
"I also want to review her medication records. Some of the information in the report I was shown doesn't match her medical history.""
"What information?""
"The report claims she has been prescribed medication for severe memory impairment.""
Daniel frowned.
"She's never taken anything like that.""
Dr. Morris looked at Evelyn.
"Have you been given any new medication recently?""
Evelyn hesitated.
"Vanessa sometimes gave me small white tablets when my hands were shaking.""
Daniel's expression changed.
"What tablets?""
"I don't know. She said they would help me sleep.""
Dr. Morris sat forward.
"Do you still have them?""
Evelyn nodded.
"In my bedside drawer.""
Daniel immediately went upstairs and returned with a small plastic container.
Dr. Morris examined the label.
Her expression became serious.
"These are not your prescribed medications.""
Daniel looked at the bottle.
"What are they?""
"An antihistamine with sedating effects.""
"Why was Mom taking them?""
"At certain doses, they can cause significant drowsiness, dizziness, and confusion, especially in older adults.""
Daniel felt sick.
"Could they have made her appear mentally impaired?""
"They could have contributed to confusion and increased her risk of falling. I can't determine how much she took or what effects she experienced without more information.""
Evelyn looked frightened.
"Vanessa told me they were vitamins.""
Daniel closed his eyes.
He remembered Ethan saying his grandmother had fallen.
He remembered the trembling hands.
The days when Evelyn seemed unusually sleepy.
He had attributed everything to age.
Now the pieces were falling into place.
Michelle carefully placed the medication bottle into a bag.
"We'll document this and ask the appropriate authorities to review it.""
Daniel turned toward Evelyn.
"Mom, did Vanessa give you these every day?""
"Not every day.""
"How often?""
"Whenever she said I looked restless.""
Dr. Morris looked concerned.
"Mrs. Carter, please don't take anything that hasn't been prescribed directly to you.""
Evelyn nodded.
"I won't.""
The meeting ended shortly afterward.
Daniel walked Dr. Morris to the front door.
When he returned, Vanessa was standing in the living room.
She had apparently arrived while everyone was occupied.
Her eyes were fixed on the medication bag.
"What is that?""
Daniel didn't answer.
Vanessa looked at Evelyn.
"Why did you give them that?""
Evelyn lowered her eyes.
Daniel stepped forward.
"Don't speak to her.""
Vanessa turned toward him.
"Those tablets were harmless!""
"Why were you giving my mother medication that wasn't prescribed to her?""
"I was trying to help her sleep!""
"You told her they were vitamins.""
Vanessa's eyes filled.
"She was restless. She kept getting up at night.""
"Then you should have called her doctor!""
"I didn't think it was a big deal!""
Dr. Morris, who was still near the doorway, turned around.
"Mrs. Carter, giving an elderly person medication without proper medical guidance can be dangerous.""
Vanessa looked at her.
"Stay out of my marriage.""
Dr. Morris didn't respond.
Michelle stepped forward.
"Mrs. Carter, we need to discuss the documents you submitted.""
Vanessa's expression changed.
"I have nothing to discuss with you.""
"Your name appears on the care facility application, the power of attorney paperwork, and several financial authorizations.""
"Those were family arrangements.""
"They are now under formal review.""
Vanessa looked at Daniel.
"You've brought lawyers into our home?""
Daniel answered quietly.
"You brought fraud into it.""
Vanessa began crying.
"I did everything because I wanted a future with you!""
Daniel looked at her for a long moment.
"Then why did you make my mother afraid to eat dinner?""
Vanessa covered her face.
Nobody answered.
Then Daniel's phone rang.
It was Michelle's assistant.
She had received a new document from the court registry.
Michelle read it.
Her expression turned serious.
"Daniel, there's a problem.""
"What now?""
"The court has scheduled an emergency hearing for tomorrow morning.""
"That's fine. We have the medical assessment.""
Michelle shook her head.
"Robert has submitted a second affidavit.""
"What does it say?""
She looked directly at Daniel.
"It claims that you have been financially exploiting your mother and that Vanessa has been the only person protecting her.""
Daniel stared at her.
"That's a lie.""
"I know. But there's a witness statement attached.""
"From whom?""
Michelle turned the document around.
Daniel read the name.
His heart stopped.
*Ethan Carter.*
Beneath the name was a statement claiming that Daniel had threatened to abandon his mother unless she signed the property documents.
Daniel looked toward his son, who had just entered the living room.
Ethan's face was pale.
"Dad," he whispered.
Daniel knelt in front of him.
"Son, did you sign this?""
Ethan shook his head violently.
"No!""
Vanessa looked away.
Ethan began crying.
"Mom told me it was just a school paper. She said I needed to write that Grandma was confused.""
Daniel pulled his son into his arms.
Michelle took the document.
"Don't worry, Ethan. Nobody is going to make you say something that isn't true.""
But Daniel wasn't looking at the document anymore.
He was looking at his wife.
"How could you use our son?""
Vanessa's lips trembled.
"I didn't know they'd use his name like that.""
Daniel stood.
"Then who prepared this statement?""
Vanessa said nothing.
Her phone vibrated.
A message appeared on the screen.
Daniel saw the name before she could hide it.
*Robert Cole.*
May you like
And the message was short.
If Daniel asks, deny everything. Tomorrow is our last chance.
